Affiliate Terms
Registered in the Netherlands (KvK 93795475)
These Affiliate Terms apply when you join the testroute.co.uk affiliate programme and share links to our website. testroute.co.uk is operated by Clear Drive. You agree to them by ticking the box when you join. Our Terms and Conditions still apply to your use of the website; on anything about the programme, these Affiliate Terms take priority.
1.Definitions
In briefThe words used in this document: the programme, your dashboard, your link, a referred sale and your commission.
In these Affiliate Terms:
- We, us: Clear Drive, registered in the Netherlands (Chamber of Commerce / KvK number 93795475), trading as testroute.co.uk.
- Programme: the testroute.co.uk affiliate programme described in this document.
- Affiliate ("you"): the person who has joined the Programme.
- Dashboard: your affiliate area on testroute.co.uk, with your links, banners, clicks, commission, payouts and settings.
- Link: any referral link from your Dashboard that identifies you.
- Referred Sale: a purchase on testroute.co.uk that we credit to you under section 3.
- Commission: what you earn on a Referred Sale under section 4.
- Payout Minimum: £50, the balance of Commission due that must be reached before you can request a payout.
2.Joining the programme
In briefJoining is free and open to anyone aged 18 or over. New accounts are approved automatically, but we can still review, refuse or close an account.
Joining is free. You must be at least 18, give accurate details and keep them up to date. One account per person.
New accounts are approved automatically, so your Link works as soon as you join. We may still review any account at any time and refuse or close it, for example if the details are not genuine or the way you promote us does not fit these Affiliate Terms.
Joining does not oblige you to promote us.
3.Your link and how sales are tracked
In briefA purchase counts as yours when somebody buys within 30 days of clicking your link and yours was the last affiliate link they clicked. Tracking uses a cookie, so not every sale can be tracked.
When somebody clicks your Link, a cookie in their browser records that they came from you. If they buy within 30 days of that click, the purchase is a Referred Sale. If they click another affiliate's link after yours, the most recent click counts.
Tracking depends on that cookie. A purchase may not be credited to you if the buyer declines or blocks cookies, clears them, buys on another device or in another browser, or reaches the website without your Link. We are not responsible for purchases that could not be tracked, and we do not credit a purchase on the strength of a screenshot or a claim alone.
Your Dashboard shows the clicks, Referred Sales and Commission as we record them.
4.Commission
In briefYou earn 20% of what the buyer pays for a Referred Sale, excluding VAT, with no cap. Your own purchases, refunded orders and fraud do not count.
For each Referred Sale you earn 20% of the amount the buyer actually paid, after any discount and excluding VAT. There is no limit on how much you can earn.
No Commission is due on:
- purchases you make yourself, or that are made for you or your household through your Link;
- orders that are cancelled, refunded or charged back;
- purchases we reasonably believe came from a breach of these Affiliate Terms, from fraud, or from misleading or automated traffic.
If an order is refunded or charged back after its Commission has been paid, we may deduct that Commission from your next payouts.
5.Payouts
In briefOnce the Commission due to you has reached £50, you can request a payout in your dashboard. We pay it to PayPal, normally within 48 hours.
Commission is paid in pounds sterling to the PayPal address you enter in your Dashboard, under Settings. You are responsible for keeping that address correct: a payment sent to the address in your Dashboard counts as paid.
You can request a payout in your Dashboard once the Commission due to you and not yet paid has reached the Payout Minimum of £50. We normally pay a request within 48 hours. Until your balance reaches £50 there is nothing to request yet, and it stays in your Dashboard. We cannot pay a request while there is no PayPal address in your Dashboard.
Any fee PayPal charges you for receiving or converting a payment is yours.
You are responsible for declaring Commission as income and for any tax due on it. We do not deduct tax.
6.How you may promote us
In briefSay only what is true. Never promise a pass, never call our routes official, and always make clear that you earn from the link.
Nobody can promise a learner a pass. A promise like that is the quickest way out of the programme.
You may share your Link on your own website, channel, social media and newsletter, and in conversation, as long as you keep to these rules:
- Be truthful. Describe testroute.co.uk as it is: video and information about the roads around driving test centres in England, to help learners prepare. Do not invent features, prices or offers.
- Never promise a pass, a better chance of passing, or a pass rate.
- Never call our routes official. They are not DVSA routes, and they are not "the route you will drive": the examiner decides the route on the day.
- England only. Do not suggest that we cover test centres in Scotland, Wales or Northern Ireland.
- Say that you earn from the Link, clearly and before somebody clicks, as the CAP Code and the Competition and Markets Authority expect, for example with "Ad" or "Affiliate link".
- No spam. Do not send emails or messages with your Link to people who did not ask for them, and follow the Privacy and Electronic Communications Regulations.
- No bidding on our name. Do not bid on "testroute", "testroute.co.uk" or similar words or misspellings in search or social advertising, and do not use them in a domain name, account name or app name.
- No tricks. No cookie stuffing, hidden or forced clicks, automated traffic, links that hide where they lead, or cashback and rewards for using your Link that we have not agreed to in writing.
- No fake reviews or testimonials, and do not present yourself as testroute.co.uk or as speaking for us.
- Nothing unlawful, hateful or misleading next to your Link.
We may ask you to change or remove anything that breaks these rules. If you do not, or if the breach is serious, section 10 applies.
7.Our name and materials
In briefYou may use the banners and descriptions in your dashboard, and our name, to promote us through your link. Do not change our logo or suggest that you are us.
While you are in the Programme, we give you a limited, non-exclusive, non-transferable licence, which we can withdraw, to use the banners, images and descriptions in your Dashboard, and our name, only to promote testroute.co.uk through your Link.
Do not change our logo or materials in a way that alters their meaning, and do not use our video footage beyond what we provide for this purpose. Stop using them when you leave the Programme or when we ask you to.
All rights in our name, logo, content and materials stay with us, as set out in our Terms and Conditions.
8.An independent relationship
In briefYou promote us as an independent party. You are not our employee, agent or partner, and you cannot make promises on our behalf.
You take part in the Programme as an independent individual or business. Nothing in these Affiliate Terms creates an employment relationship, a partnership, a joint venture or an agency between you and us. You cannot make promises, accept orders or enter into agreements on our behalf.
You are free to promote other products and services, as long as you do not present them as ours.
9.Personal data
In briefYour dashboard shows totals, not who bought. We use your details to run the programme and pay you, as described in our Privacy Policy.
Your Dashboard shows clicks, Referred Sales and Commission. It does not show who bought, and we do not share buyers' personal data with you.
We use your name, email address, PayPal address, payout history and the activity on your Link to run the Programme, pay you, prevent fraud and keep the records the law requires. How we handle personal data is explained in our Privacy Policy.
If you collect personal data from your own audience, you are responsible for that under data protection law.
10.Changes, and leaving the programme
In briefWe give 14 days' notice before a change that affects what you earn. Either of us can end your participation; a balance that has reached £50 by then is still paid on request, a smaller one is not.
We may change the Commission rate, the cookie period, the Payout Minimum, these Affiliate Terms or the Programme itself. Before a change that affects what you earn, we give you at least 14 days' notice by email or in your Dashboard. Commission on sales made before a change takes effect is calculated under the old terms. If you do not agree to a change, you can leave the Programme.
You can leave at any time by emailing us. We may end your participation, or the Programme as a whole, with 14 days' notice, and immediately if you seriously or repeatedly break these Affiliate Terms.
When your participation ends, your Link stops earning. If the Commission due on genuine Referred Sales made before the end has reached the Payout Minimum of £50, it is paid out on request. A balance below £50 is not paid out. If we end your participation because of a breach, no Commission is due on purchases connected to that breach.
11.Liability
In briefWe are not liable for sales that could not be tracked, downtime or indirect losses, and our liability is capped at the Commission paid to you in the last 12 months. Nothing limits what the law does not allow.
Nothing in these Affiliate Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited by law.
Subject to that, we are not liable for loss of profit, loss of opportunity, or any indirect or consequential loss, nor for purchases that could not be tracked, interruptions of the website or the Dashboard, or the acts of PayPal or other third parties. Our total liability to you under these Affiliate Terms is limited to the Commission paid to you in the 12 months before the claim arose.
You are responsible for what you publish, and you will compensate us for any loss, fine or claim that results from your breach of section 6.
12.Governing law and contact
In briefThese terms are governed by the law of England and Wales. Questions about the programme, or leaving it, go to our email address.
These Affiliate Terms, and any dispute about them, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless mandatory law provides otherwise.
